Acceptance of terms
These Terms of Service (“Terms”) are a legal agreement between you and Habitville (“Habitville”, “we”, “us”) governing your use of the Habitville app and the habitville.co website (together, the “Service”). By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you don't agree, please don't use the Service.
Who can use Habitville
You must be at least 13 years old (or the minimum age of digital consent in your country) to use Habitville. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.
Your account
- You're responsible for keeping access to your account secure, including any sign-in method you use such as “Sign in with Apple”.
- You're responsible for the activity that happens under your account.
- Let us know promptly at hello@habitville.co if you believe your account has been compromised.
Subscriptions & payments
Habitville is free to start. Habitville Plus is an optional paid subscription that unlocks additional features.
- Billing through Apple. Plus is sold as an in-app purchase and billed by Apple through your App Store account. Prices are shown in the app before you buy.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends. Manage or cancel anytime in your Apple ID subscription settings.
- Refunds. Purchases are handled by Apple, so refund requests are subject to Apple's policies. We're happy to help where we can.
- Price changes. If we change subscription pricing, we'll give notice as required, and changes won't affect your current paid period.
Acceptable use
To keep Habitville safe and working for everyone, you agree not to:
- Break the law or infringe anyone's rights while using the Service.
- Reverse engineer, tamper with, or attempt to disrupt or gain unauthorized access to the Service.
- Use bots, scrapers, or automated means to access the Service in ways we haven't permitted.
- Resell, sublicense, or commercially exploit the Service without our written consent.
Your content
Your habits, check-ins, and the village you build are yours. You keep ownership of the content you create in Habitville. You grant us only the limited permission needed to store, sync, and display that content back to you so the Service works. We don't claim ownership of your data, and we describe how we handle it in our Privacy Policy and Data & deletion page.
Our intellectual property
The Habitville app, including its design, artwork, the village world, logos, and software, is owned by us and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. These Terms don't transfer any of our rights to you.
Disclaimers
Habitville is a habit-tracking tool, not medical, psychological, or professional advice. It's provided “as is” and “as available”, without warranties of any kind, to the fullest extent permitted by law. We don't guarantee that the Service will always be uninterrupted, error-free, or that it will produce any particular result.
Limitation of liability
To the maximum extent permitted by law, Habitville will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data or profits, arising from your use of (or inability to use) the Service. Nothing in these Terms limits liability that can't be limited under applicable law.
Termination
You can stop using Habitville at any time and delete your account (see Data & deletion). We may suspend or end your access if you breach these Terms or use the Service in a way that could harm others or us. Terms that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
Changes to these terms
We may update these Terms as Habitville evolves. When we make material changes, we'll update the “Last updated” date above and, where appropriate, notify you in the app. Continuing to use the Service after changes take effect means you accept the revised Terms.
Governing law
These Terms are governed by the laws applicable where Habitville operates, without regard to conflict-of-law rules. Any disputes will be handled in the courts with jurisdiction there, unless your local consumer law gives you the right to bring proceedings elsewhere.
